faulty MBP ?

I have a new MBP and 5 times now the screen / laptop has freezed up on me

There is a 1" black bar at the top of the screen. Only a complete power off fixes the problem. Today it powered back on but the screen was very dark.
It gave me the login screen but looked like the back light was off.

I phoned apple care and there closed.

I phoned the store but were not any help.

Should I rebuild the OSX again? take it back ?

Make an appointment at your local store's Genius Bar. They will have a look, fix anything that is off, or swap it out if it is a serious defect.
