Fido/Rogers - 10MB download restriction on apps/podcasts still in place on 3G?

I get a message that I can't download anything over 10MB for any app or podcast downloads over the 3G network. I am using the Fido cell service...is this a cellular restriction or an Apple restriction? I thought that OS3.0 got rid of this restriction? :(

It's the same on AT&T... Must be an agreement Apple made with the carriers.
