My wife had her iphone stolen with the app set up and everything. The person has shut the phone off and not turned it back on yet. I do have an old iphone 4 laying around that i could put her backup data onto, if i do this will the tracking of her lost phone get messed up. Apple told me that the find my iphone feature is attached to a specific sn (which i find hard to believe). Please Help..

Only way your going to be able to track the iphone is if A) it has data or B) they use it on wifi....

If your a GSM carrier, ie ATT, they will just discard the SIM and then wipe so you won't be able to track. Regardless you can call your carrier and have the phone reported stolen so they cant use the device.

It is ATT. So you are saying it is tied to the SIM not to the SN of the phone. So if i restore my old IP4 it will basically tell ATT "no dummy this is my phone, not the one stolen", am i correct to have that assumption?
 
The find my iphone is tied to your iCloud account. Example, I signed into my iCloud account for my iPhone, iPad and Macbook. When I go to locate device it gives me locations on all devices. If my iPhone gets stolen, I then use an old phone, if they didn't wipe my stolen phone yet, I would see location of now all 4 devices (granted the stolen one have data some how)

Not a problem. Best of luck to you. Couple things, ATT offers insurance that covers theft.... could talk to retentions and see if they can add it for you. I believe the deductable is $150? to get a new phone. Better than paying outright/burning an upgrade.

Or if you paid with a credit card, I heard credit card companies offering some sort of insurance in getting a new one as well. Just a couple options for you.
