Getting 1.25 hour talk time on full battery (3GS)

Could be. You need to post more info. How long you've had it? what else is turned on? Ever restored? Etc.

thats a problem my battery was a little bit more than half way last night when i was on the phone for 3hours after my phone call i was at 10%

I wouldn't be surprised if my phone was (close to) dead after talking for an hour straight. Apple claims a whole lot more but fluctuating signal, speakerphone, pulling phone away from face (illuminating display), and I'm sure several other factors can alter this estimate significantly.

Had it like two weeks. Not sure what else is on, like I said I turned off push, 3G is on, Wifi is on. Nothing out of the ordinary I don't think. I rarely use the iPod function.

That is beyond bad. Go get a GB appointment and get them to check your battery.
