Getting iPod warranty service without proof of purchase?

Hey I bought this iPod 160g classic on craigslist and it doesn't boot up

Stuck in this red x. I checked diagnostic mode, most likely a HDD problem

I checked the serial and it has applecare till 2009 oct!

Can I just take this to an apple certified spot and fix or get exchanged (hopefully the latter =0)

I dont have a proof of purchase or anything

Yes you should be able to take it an Apple Store. They will check the serial number and you should be good to go.
