Guest user issue

Hey there,

I was apply using Yosemite with my Guest account enabled to use search my Mac.
I've upgraded to El Capitan Beta with no problems and the user Guest was still there.
Today I've upgraded to machines to official release of El Capitan:

iMac 27 late 2009 no problems, Guest user is still there.
macbook pro 15 late 2013 Guest user is gone and there is no way to bring it back. The guest user is enabled in the preferences but no way to get it at boot. If I logout from my user i can finally see it but i can just boot into browser!!!!!

need some help.
