I'm getting a refurb late 11 MBP. I'm on an early 08 Black MB. I upgraded this HD to a 750GB and the MBP will have a 500GB. Can I swap the hard drives with no problem or will I have to back everything up, swap and do a fresh install?

As far as I know, a simple swap should be perfectly fine.
 
If you know how to swap HDD's, its easy.
All you have to do is just swap it around.
No back up or anything needed unless if you really want to be safe with your data.
 
Will be fine as long as you have the latest OS X updates installed. First boot will take a bit longer than usual while it re-adjusts to the new hardware.

The 10.6.8 drive from my 2008 uMB worked fine when swapped into the replacement late-2011 15" MBP.
