iPod touch Help, my Ipod touch got turned off and now it won't respond!!

HELP PLEASE.
My turned off my IPOD TOUCH and then it won't open back. I tried DFU mode and i held it for over 1 minute and no response. The screen is black, nothing is coming from it, i think the battery died but its only 1 month old? I tried to plug it in computer, but no response either, please help, my ipod costed 289.99 and i don't think apple will help if its jailbroken!! and I don't want to get fined if they find out or something!!

Plug it into your computer. Press and hold the power button for 10 seconds.

Calm down. Just put it into DFU and restore the original firmware on to your Touch. If you said DFU doesn't work, take it to an apple authorized dealer and get them to repair it for you.
