Got my Macbook today and unlike my iMac, there are no smart folders already on this?
 
Finder > Preferences > Sidebar

Yes. What version of Mac OS X are you running?

If you're running Lion, try this:

1. Create a new Smart Folder in Finder. Customize as you like.
2. When prompted to save, it will automatically want to go in "Saved Searches." This is the correct place for this. An option to add the new Smart Folder to the sidebar will be available.
