I want to cancel T-Mobile and go back to AT&T. I have the new Simple Choice plan, with a balance of about $340 left on my 32GB iPhone 5S installments.

Will they charge me an early termination fee even if there's "no contract"? Can I just return the phone and go to AT&T?

No, but they will make you pay the $340 if you want to cancel. It's the remaining balance you have left on your phone that you have to pay.
 
Someone correct me if I'm wrong, but yes, once you pay off the remaining balance of your EIP you'll be able to keep the phone and Tmobile should unlock it for you.

I'm asking because I bought my 5S through T-Mobile back in November and my latest bill due tomorrow still does not include a payment for the phone. I have the unlimited plan and my monthly payments have been $77 each and every month.
 
Just port the number to AT&T. That automatically cancels the line. You'll have to pay off your phone and possibly ask to get it unlocked.

You go through two bill cycles before you start paying the EIP. So the third month in is when it kicks in.

And yes, when you go to AT&T, if you wanna keep the same number, they T-Mobile service will automatically be cancelled when they that you took that phone number to another carrier. If you want a new number, then you'll have to call and cancel it yourself but the remainder of your EIP becomes due right away.
 
Odd. Have you logged onto your my t-mobile page and seen that the EIP doesn't reflect the 5 months you would have paid?

It doesn't list any charges for the phone. There are only taxes and fees that bring the $70 plan up to $77. I fully expected to be paying for the phone by now.
 
or maybe lucky you somebody made a mistake and you have a completely free phone :D

To the OP: there are no fees for the contract; just a fee for the phone. Any Tmo iPhone will work on AT&T, you'll just have to get it unlocked which Tmobile should be able to do for you (within 48 hours of paying off the phone)

You are correct. I did some searching and it appears that they gave me my 5S for free. The T-Mobile site says that anyone who has purchased a phone using the EIP plan, can check the balance owed by looking under billing and then at the bottom of the page, look under equipment installment plan. There it says my account has no EIP plans.

Under phone, it also lists my 5S as being a 16GB which is wrong.

If that is the case, you may be able to request an unlock on the phone now. Hopefully that doesn't lead them to fixing the error. :)

I have a 32gb as well and it lists mine as a 16gb unless I change it on there myself so that's not an issue. But I highly doubt that you got a free iPhone if you signed up for an EIP. How much did you pay up front for it?
 
You should make a sign that says you're breaking up with them and take a picture of it! :D

You'd need to wait 40 days since setting up service with T-Mobile to unlock the phone. There are a few requirements before they can submit the request.

+40 days of active service and your balance must be $0 on both EIP and your monthly charges. Device must have usage within last 7 days as well. I just unlocked mine from Tmobile a few weeks ago. Worked perfectly. I did mine through chat. Took about 2 days to get an email with my instructions.
 
seems most of your questions have been answered. The phone will work perfectly on ATT's network once it is unlocked. Just hope the unlock does not make them realize they made a mistake. You would still own the entire phone balance it appears.
