I have noticed the same kind of things for a number of applications, not just Photos. I suspect there is a system wide setting to change, but have not found yet.
 
Lately when I click an icon on the dock to launch an app., it opens behind my current active window on my M4Pro Mac Mini. So just now, viewing this forum page in Safari, I clicked on Photos and the window opened behind my Safari window.

I'd be interesting to learn how to deselect this new 'feature.'
 
This issue seems to be related to how the new Sequoia update manages window layering. A workaround that might help is to try resetting your app preferences. Close the Photos app, then open Finder and go to "Go" > "Go to Folder" and type `~/Library/Preferences/`. Find the preference file related to Photos, like `com.apple.Photos.plist`, and move it to your desktop. Restart your Mac and open Photos again to see if the issue persists. If this doesn't work, you may want to report this behavior to Apple, as it could be a bug that needs addressing in a future update.
 
I tried option-right-clicking the Finder icon and relaunching. This solved the issue of Preview windows showing up behind Finder, at least for now. I'll update if it things change.
 
Yes, same thing happens to me. And relaunching Finder only fixed things for a short time - now it's back to opening files in Preview behind the Finder window. It seems like if Preview is already running (if it has a file open already), it will open a file in front of Finder. But as soon as I close the Preview window, Preview quits. And whenever it launches, the first thing it opens falls behind the other windows.
 
Yes, newly opened Apps or windows that sometimes hide behind the current ones.
This just started happening for me! I thought I had accidentally changed something to make it happen. But, now I see it’s not me. Not like I can’t use the computer. But, it’s annoying. I will report it maybe if enough of us do, Apple will fix it. arcite, I agree where’s the Quality Control? User testing? Regression testing? This should not have gotten into the production system. (I am assuming this is a Sequoia bug). Donna

I'm not sure during which iteration of Sequoia is started but yes, pls do file a report with Apple. I usually do.
 
I haven't had the "photo thing" talked about, just the very annoying "Apple News" window popping up on my MacBook screen every time I power it. I looked at all the settings trying to figure how to disable Apple News, but haven't been successful, even after disabling the News app.

Indeed, I have this happening to me regularly with various apps and on several different computers. It is not related only to Preview, but system wide. And very annoying.
Essentially, Apple broke the algorithm that chooses which window should appear on top of the others.

Good question.

This activity noted here, too - though essentially any file opened from another window displays behind that window. That's what's happening here.

Perhaps related, same sort of action in my Firefox - click on a link from Bookmarks drop-down list and website opens behind the drop-down. The list doesn't go away until the website is clicked.

I don't recall these actions immediately after last OS update - it's almost as if it is some sort of time-released bug.
