i need to update 3gs 3.1.2 to 3.1.3 for unterther jailbreak

Spirit JB's 3.1.3 & 3.1.2
You cannot restore to either of these unless you have the relevant SHSH files stored either locally or through Cydia.
You cannot use iTunes 9.2 for a spirit JB...downgrade to an earlier version if you need to.

this current set i'm working on is a fresh unjailbroken 3gs still on 3.1.2, i'm trying to get him a untethered jailbreak by using Spirit, so i had to upgrade his version to 3.1.3 as Spirit only works on 3.1.3, it just that i realised that itune patch up or something is wrong somewhere

Unless this phone has a 3.1.3 SHSH stored you will not be able to restore to 3.1.3.
Spirit Works with 3.1.2!?

Requirements:
Any iPad, iPhone, or iPod touch on firmware 3.1.2, 3.1.3, or 3.2.

Not sure what you mean by itunes patch-up. iTunes must be lower than 9.2 for spirit to work.
