If I get my 4S replaced at an Apple store will it be loaded with iOS 6 or 7?

I don't want to lose my jailbreak and I've heard iOS 7 drains your battery faster but my sleep button is stuck.

If 7, will anywhere fix the sleep button? I have a workaround temporarily using Activator but would prefer to fix this.
 
Op honestly it spends on the stores stock levels and the popularity of the model. Your 99.9% guaranteed to get iOS 6.1.3 or earlier at the moment. Leave it a while and this reduces especially if it's a 32/16gb model
 
get it replaced ASAP, pretty much guaranteed to get it on ios6 unless you have a really high volume store.

Cool thx....will iOS 6 cost me battery life or slow down my phone?

It will be on iOS6.

Last year, when I had my 4S swapped at Apple, iOS6 had come out already, and my replacement 4S was on iOS5, a few months AFTER iOS6 had been out.

It will definitely be on iOS6.

Is there a jailbreak for 6.13 or earlier? Will it work on the 4S? This is very important to me. Thx.

I just had my iPhone 4S (64GB, AT&T) replaced with a new one on Sept 12th at an Apple store here in Columbus, OH because my Sleep/Wake button stopped working as well (thankfully I had Applecare+ since I bought it in Nov 2011). The new/refurb 4S they gave me came with 6.0.1. I am sure your new 4S will be 6.x software as well.

6.1.2 is what you need for jb. There working on 6.1.3 but doubt we will see it
