If you live in CA or NY you have to pay taxes on the full cost of the device up front.

If you do the Apple upgrade program it's at the state where the Apple store is when you pickup the phone. I live in New Jersey, 15 miles from the Apple Store in Delaware. Delaware a sales tax free state.
