if this lawsuit does go through and the judge agrees to hold off on all sales of iPhone 5, those lucky enough to get it during the first batch of pre orders get bragging rights lol. This is going to be a mess.

I doubt it'll go anywhere. If it goes to trial it'll be two years before we see a decision on anything, so we're safe. And like hell there will be preliminary injunctions to ban the sale before trial, hah!
