Probably because you are jailbroken

What happened around the time this started occurring? Did you update iOS? Did you jailbreak? Or maybe did you install something or change a setting?

I jailbreak but don't remember havi any settings that got to do with Photos

You can't really compare your phone and his unless both of you have exactly the same tweaks installed.

One reason I don't jailbreak anymore is because for some reason you start seeing strange behavior in areas of iOS that you didn't even install a jailbreak tweak for. It's a troubleshooting nightmare.
