I have an iPhone 3G with 3.1 FW which I have jailbroken and unlocked. I don't want to upgrade to IOS4 because of the speed issues and I don't want to loose my unlock.

The problem is that the mute switch is faulty and if I take it back to the apple store, I think they will probably replace it. I assume the new one will have 4.3 FW? Will I be able to downgrade it back to 3.1? Will I be able to unlock the baseband?

Why would apple replace a 3G? And no, a new one wont have 4.3.
 
Like JMB said it will not have 4.3 cause the highest an iphone 3G can go is 4.2.1
They stopped releasing firmware updates past that for it.
Not sure what firmware will be preinstalled but if it comes with 4.2.1 or 4.1 the bb wont be unlockable.
You will then have to install the ipad BB to unlock it and losing your GPS functionality.
Also you still have Applecare warranty on your iphone 3G?
