So...here is my question:

If Apple is shipping the same 3.0 software with the 3G and 3GS, shouldn't there be a way to unlock video and voice command capabilities (as these don't need any extra hardware) without jailbreaking (aka. prior to sync)?

I am a developer and using the 3.0 GM, but I can't seem to figure out how to make this happen.

Any other developers have ideas?

They wont have the same software.. I think when you plug your iPhone 3GS in itunes knows what it is and downloads the proper software and if you try to load that software on a 3G itunes knows that the software does not belong on that model
 
So far, each iPhone model has had its own firmware assembly. While it is possible the voice command functionality is in each assembly, there is no reason to assume it will be. I guess we'll find out more after 3GS launch day.
