iPhone 3gs can't update????

I have an iPhone 3gs and when I tried to download a new ringtone it told me I had to update my phone before I could...when I plugged it into my laptop and iTunes started I tried to update it and it told me it could not read my phone and to go to the settings and restore it....but I don't want to lose any pictures and things I have on my phone...is there any way to get around this????

Create a backup via iTunes, restore it to the latest firmware and restore from backup after updating. So you're on the latest firmware without loosing any data.
