iphone 3GS dark screen and Apple Care

After 3 weeks of my new iphone screen going dark when ending a call, to being dark virtually all the time, I sent to Apple to diagnosis. They are sending
it back claiming " subjected to accidental damage or misuse " therefore not covered under warranty. This phone has never been abused, Apple's own forums have discussions of dark screens, and at ATT I was told it happens to 1 in 50. I have not seen a thread on this... common out there or not?

OMG Black Sceren

I think that black sceren caused in these reasons:
1. The softwear in it maybe not very good;
2. Got the virus;
3. SIM card is not launch very good;
4. When you talk by iPhone, it will scan the heat from your face, so it turns to black to save electriction;
5. If you always see black sceren after talking on phone, you should think about did you have a rush-charge or others, maybe key's contect can let the iPhone showed not-good.

Ok, maybe more. But I don't know more.
