iPhone 3GS has battery issues

Hey, I have a back up iPhone 3GS that I use sometimes, lately the battery has been dropping percentages and it doesn't fully charge. I purchased the iPhone through Craigslist. I checked online the status of the warranty, and seems like the original owner purchased AppleCare. Since I'm not the original owner of the iPhone 3GS, could I still take it in to Apple Store and have them replace it for a new iPhone 3GS? I'm pretty sure they'll give me a new one since the same exact problem happened to my iPhone 4.

Yeah the phone is covered. Doesn't matter the owner.
