iphone 3gs jailbreak

Good Morning Ladies & Gents,
I have read these posts and the other information,can someone please clarify as i have just bought a 3gs 32gb on Ebay, stating it was unlocked to find that it is not.
It is Running Version 5.01(9a405)
Firmware 05.16.05

So if i can read correctly this phone CANNOT be unlocked.
I would really be thankfull for a quick answer as i need to start a dispute if this is the case

Correct - without irreversibly updating your baseband to 6.15.00 (which is strongly advised against), your phone cannot be unlocked.
