I have an iPhone 3GS and am going to upgrade to the iPhone 4S. My parents currently have the iPhone original without a data plan. AT&T has not forced them to add a data plan and they have had them for several months. My father set up their accounts so that data is blocked. If I give them my iPhone 3GS and they do not use data will AT&T force them to have the data plan?

They will eventually be forced into a data plan. There a thousand threads exactly like yours and a few weeks into the OP trying a 3G/3Gs/4 with no data, they get a plan slapped on. It just happens. Even with a data block.
If you don't want mandated data, go prepaid.
