If I purchase a 3GS from eBay or just second hand in general and it develops a fault can I still get repair or replacement from Apple or if outside warranty even pay the £170 or so to have it replaced?
 
You're just gonna get another refurb though. I laugh at the people who think they are getting BRAND new replacement phones. It'll be no different than the one you pay for on Craigslist.

There is quite a difference with the used ones on craiglist and refurbs. With the used one the battery could already have lower capacity from use, it can also be scratched and blemished and there is no warranty unless the original seller provides one. With the refurb you get Apple's warranty, the battery and all external parts are new.
