iPhone 3gs with no sim and iOS 5.01

My father in law gave me his iphone 3gs. When I got home i updated it to get rid of the stuff he had on it. Now it tells me to insert a sim to activate phone. I dont want to use as a phone as it is a gsm phone and I have cdma service. Is there a way to use just as an ipod touch and not a phone? and how? I am a noob with apple products. Thanks for your help
