iPhone 4 and earbuds with remote

Anyone else having trouble with the remote on 3rd party earbuds? I have a set of V-Moda Vibe Duos and the remote button isn't working properly with my new iPhone 4. All the button appears to do is make the volume go all the way up and then back down to where it's set. It doesn't play or pause and it won't skip to the next or previous track. I also get a sort of rhythmic crackling very softly. Everything works fine with the apple earbuds (controls work and no noise) and the V-Modas work fine with my iPod touch (the 1st gen so I can't use the button), as far I know everything was also working fine with my 3gs before I sold it.
