Iphone 4 photos app issue

Is anybody else having this issue with the photo app?

I went to the apple store and got a new phone but after a few days the same thing happened.

It usually happens when I see a video I recorded, then when I go back to the app I cant access the photos because it appears to high up so I have to force close the app and reopen it.

I even reset the phone completely and after a few days, the same issue started.

Ya, I have the same issue as well so I killed the app and it went back to normal.

yeah I wonder if that is a software issue then, it is a little annoying as it keeps happening constantly now
