iPhone 4S from bestbuy

I bought my 4s from bestbuy on Halloween I wanted the 5 but they were not in stock then so I had to settle for the 4s so the guy said i could return it when the 5 was in stock but the 4s gave me overheating problems & apple replaced it with a new one so now I'm stuck with the 4s is it true i can't take it back to bestbuy for the 5?
