I just got an iPhone 4S yesterday. For some reason, the headphones work just fine - usually after I fiddle with the cord - but the remote doesn't. I think I heard that you could stick a needle into there, but I for one don't want to risk damaging the headphone jack - I'll want it when I start walking again. I'm looking forward to being able to finally control my music and more with my voice.
 
The headphones are covered under warranty so take em back to the apple store. Or use the online self service and they will send you a new pair
