IPhone 4s Lockups 5-10 times a day

My new 4S is constantly locking up.
When I click the power button to turn the screen on I get the battery low plug in power source animation. Despite having a full charge. Only way to get it to boot is to plug it into a power source.

Sound like a hardware issue?

Iphone 4S, IOS 5.01, verizon
