It's doubtful. Now that iOS 6 can no longer be signed if you try and downgrade they have likely updated ALL their replacement phones.
 
I highly doubting it. They want all phones on iOS 7 so I doubt a phone they give you will have iOS 6 on it
 
I got my iPhone 5 replaced yesterday. It had 6.1.4 on it. Tech told me that they don't have the iOS 7 software in the store so none of the replacements had iOS 7 on them. Thought that was really weird. Usually they have all the current software images on the tech computers and external hard drives in the back of house genius room.
 
iPhone 5 is coming with iOS 6.1.4 (screen shot of fresh replacement from last night at closing time) and it works just fine with LTE on Straight Talk for $36.50 per month. If you get it swapped out you will more than likely get the tweaked version which has high speed data on all bands.
