iPhone 5 bad imei with warranty?

Hi guys I'm new to these forums and just needed some advice and questions answered. I recently bought an iPhone 5 64 gig AT&T from craigslist. Later did I find out it was reported stolen bad imei ,so I decided to do some research and was curious to see if it had warranty and it did. It has warranty for another year. I was thinking if the phone was "accidentally" damaged, is it possible to send it in and have another one shipped that's not blacklisted? With a whole new imei?
