I don't think it's likely due to how large of a company Apple is. They'd never allow the phone to be banned in the US.

Hardware patents used for a standard are near useless. The worst HTC could do is force Apple to pay a few cents in licensing, but, since they don't make other competitors pay for them, even that would be difficult.

As usual, Software patents > Hardware patents.
 
Every time I see someone sue Apple to try to ban them I think either a.) "can't beat 'em, sue 'em" or b.) they want a piece of the Apple pie (case in point: goophone)
 
Is the 4G LTE technology samsung uses different? Or do they pay HTC a licensing fee?
