Just as the title says, when i tried to restore from a previous backup a pop up came up and says "iTunes could not back up the iPhone because the iPhone refused the request."
 
please!! This really sucks!

What sucks is that you bumped your post.

Set it up as a new phone. Problem solved.
 
First make sure you create a full, special backup of your 4S. I've learned that the hard way and ended up going to tape for a file.

Your iPhone 5 may be refusing a backup, but that's not what you're trying to do. If it's being difficult, erase all content and settings, set it up on-screen, then plug it into iTunes. When asked, restore from backup and hopefully you'll be good to go.
