By chance, are the latest shipping iphone 5 coming with a jailbreakable os or has it already been patched? I'm up for an upgrade in a few weeks but if I won't be able to jailbreak I think I'd rather buy a used one on the proper os.

Patched OS is already released.
Some are still jailbreakable, just depends on stock at where ever you buy it from... if it is older stock, it may come with 6.1-6.1.2 software, however it can come with 6.1.3, so it is literally a gamble.

I just bought a 64gb from Verizon last week. It was on 6.1.2. I jailbroke it right after I put it in a case. You might get lucky.
My brother just bought a 64gb from Verizon last week as well and it came with 6.1.2.
64GB are probably the slowest to sell. I would think chances are almost none with a 16GB and pretty slim with a 32GB at this point. Just some moderately educated guesswork. 
Don't see why. If your requirement is to be able to run software of your choosing and Apple don't meet it, why wouldn't you stay on the platform that does?
