Well, they kind of are, but the little button doesn't do anything any more. Can I get them swapped at an Applestore or will this one have to come out of my own pocket? I've only had them a couple of months.

Yes, you can get it replaced.

I usually just use the do it yourself swap out on the apple support website. I've gone through like 4 of the iPhone ear buds. One had a blown bud, one had what you describe with the clicker stopped working. One had the mic stop working, and I think the other one had a blown ear bud also. They are very cheaply made, in my opinion, and you should get it replaced under warranty.

I have the same problems with my headphones, just tried to do an online exchange but since I already put in for the USB power adapter to be replaced because of the recall I can't do it -- repair already in progress. That is annoying.
