iPhone replacement has scuffs and marks

I know they are usually refurbished, most the marks which were black I managed to get off, but there are some scratches and marks around the metal band and the base looks like yellow glue under the glass (white iPhone)

Is this normal for a replacement or just a bad one :(

1) Its not a refurbished phone-too early. 2)Not normal at all. Call applecare right now.
