We have two phones on our AT&T account. My wife is using an iPhone 6s Plus. I am using an iPhone XS Max. We want to trade-in the iPhone 6s Plus and buy an iPhone 12 Pro Max. I will use the iPhone 12 Pro Max, wife will use the old iPhone XS Max.

is this idea complicating things? Should we switch phones before we upgrade so it is clear the new iPhone will be used with my phone number?

Domwe need to tell AT&T what we are doing? Both phones are paid off.
 
I don’t see any complication. I would assume you just need to do the trade in, switch your SIM card to the new phone, and restore your backup to it. Then your wife can put her SIM card to your XS, and then restore her backup to it. I don’t see what AT&T has to do with who use whose phone.... but then again I’m always surprised at the silliness of American wireless carriers. :D
