Yes. You just can't use it if you are in the US without doing a little bit of work (there are posts here on how to do it).

Who said it was apple? I believe it's AT&T personally. Havent read about it though

It's not Apple, it's AT&T. According to AT&T it will be out later this summer, same with MMS.
