iPhone with new sim card?

Hi, as the new 4G is coming out, AT&T has contacted my friend saying he can bypass his upgrade date, and upgrade when the new iPhone comes out. He currently has the 3GS and is planning to give it to me. However, I currently have an HTC Fuze without a data plan. I was wondering, can I just stick my sim card into the phone without having to buy the data plan? I have read that I would be grandfathered into my plan without data, but I am not sure. Any help is appreciated, thank you.

Doubtful. AT&T requires a data plan and will text you soon after inserting your sim card that you will need to add one.
