I dont know if am asking this correctly but here it goes.

i have an iphone 3GS with old bootrom and firmware 3.1.3.
I dont have an ShSh saved cause apple is not signing them.

is it possible to upgrade to a custom JB OS4 custom or whatever.
the phone was JB by spirit i think my friend did it for me..

is that correct i hope so..

and HI am new to all this :D:p

You will have to wait for new jailbreak tools.

Actually if you have the old bootrom you can install spirit2Pwn from cydia.
add the repo http://repo.woowiz.net to Cydia sources.
Then once installed you can put your phone in Restore mode and update to custom 4.0 IPSW created with pwnage tool.
 
I don't know what the heck is going on with the hold 'you can't save SHSH anymore that's lower than 4.0.1' and I'm not an expert on this. I did back up my iPhone 4 on tiny umbrella before the cutoff time and I know you can no longer back up the iPhone 4's SHSH. What I CAN tell you is this is what I did YESTERDAY to a old bootrom 3GS (7/17/10):

AT&T Locked iPhone 3GS 32gb (week 25th build, OLD 359.3 bootrom)

Steps I took to Jailbreak / Unlock:

Previous owner reseted settings and cleared contents (still on 3.1.2)
Jailbreak 3.1.2 with Blackra1n
Unlocked with sn0w
Backed up SHSH in Cydia
Download 4.0 for 3GS (download from iClarify and make sure your iphone isn't plugged in)
Use Pwnage Tool to build custom IPSW
Put the phone in recovery (NOT DFU - not sure why it wouldn't work with DFU)
Install custom IPSW
iPhone now jailbroken with custom IPSW
Unlocked with Ultrasn0w through cydia

I now have a working 32gb 3GS on iOS4 (old bootrom) on TMobile. I'm not sure why the DFU mode didn't work for me but I noticed this on several other 3G and 3GS I unlocked throughout the years. I would advise to still try DFU mode first, then try recovery if you can't get it to work.

There is no way you "backed up" your SHSH to Cydia yesterday for 3.1.2. It was more then likely already saved. You don't use DFU when upgrading.

So do you think I just got lucky with buying a phone that's previously jailbroken and SHSH saved? What's a good way to check with shsh Cydia has backed up for this. phone? I'm pretty sure it was never jailbroken because I got it off a guy on ATT who doesn't even know a thing about the iPhone other than that its on his ATT network and he has upgraded to a 4.

If I got lucky, then I'll be damn that's pretty sweet. Not sure how that happened then. So according to what yore saying - no iPhones coming from ATT regardless if it's 2G 3G or 3GS can be jailbroken now unless it was done previously in the past?

Firmware verification is only done on the 3gs's, that's the reason SHSH's are stored. They have to be signed by Apple and only while it's the current firmware. The best way to check is to open cydia and see what SHSH's has store for your device (see image below).

The blobs are only used when downgrading and since you didn't have to downgrade it's not a problem but there is no going back if you don't have the blobs for 3.1.2.
