Iphone's IPOD issue

Has any faced with the problem where you play a playlist and you pause it with the clicker in your handsfree and after a while (not immediately) you play it again and it starts from the first song and not where you left ... Its kinda annoying..

Any setting i need to change or its just like that.. !!!

Downgrade to 1.X software?
it used to remember where you were.
I could be listening to music while walking, then when i got on a train go to video, then as i got off the train could hit the power button, and then click the button on the headphones, and it would pick up where it left off on the music, now it just plays whatever the first song alphabetically happens to be that is loaded on the phone.
