Well, my battery is on its way out, after nearly 2 years, and I'm sending it back to apple, since I have the applecare 2 year warranty. I also figured it would be a good time to tell them about my other problems (which i didn't put in the original problem ticket, and they said I couldn't add to it, but that they would mark it in my notes). My problems are that often times songs will skip to the next one and other times it the contrast will reset to the lowest settings. All kind of weird.

Anyhoo, they said that the ipod will likely be replaced, but I am assuming that it will be with another 40gb. Is there any chance that they would replace with a 60gb? Has this ever happened? If not, do they replace with a refurbished 40gb? Would it be in good condition (read: not scratched)? But really I want to know if anyone has gotten an upgrade to the latest model. (/me crosses his fingers)
