iPod iPod Stolen, can they Copy my Collection and Apple Tracking?

It's not enough that my iPod 80GB Classic was stolen but now they have my Files (Music, TV Shows, Music Videos and Movies), some were Purchased on ITMS.

Can they copy them? What about Apple tracking it using the Serial Number when Connected, is it possible?
