iPod touch Ipod touch 2nd gen Volume and Lock button Glitch.

Hi,
I have an MC model 2nd Gen ipodtouch,
It has a glitch that when i press the Volume buttons it locks it and when i press the lock button it turns the volume up then locks it.
It's Warranty has now ran out so is there a fix / can i take it back to apple and what will they do?

I've heard of this before, try to turn it off and turn it back on.

That didn't work, also when i turn it off it has to plug in to turn on
