I've had this iPod Touch for about 1 month, noticing that it has been freezing quite often randomly when pressing the power/sleep button. I've already try restoring/upgrading the firmware to latest and still the same problem. what's wrong with it?
 
Nope. It had this problem since 3.1.2. I just upgrade/restore to 3.1.3... didn't jailbreak.
 
After the restore, are you choosing to restore from backup, or setting up as new? What kind of apps or other data are you synced or downloaded directly onto the iPod?
 
I restored it, didn't use backup option. I'm using manual sync, syncing my music myself.. Apps are all from app store bought via ipod not through computer.
 
Used doesn't automatically mean out of warranty. Check your eligibility for hardware support at this link.

P.S. The iPod touch (Late 2009) was introduced in September '09 so you are still under your 1 year hardware warranty. Take it in. Just make sure that there's no drop or spill damage that could void your warranty.
 
My other problem is that the accelerometer sometime stops working.. only works when I restart the device :(
 
How does buying an iPod Touch used work when I want to use the warranty? I don't have the receipt or box.. All I got from the previous owner is the iPod Touch itself, nothing else.
 
anyone??? I don't know if I can use the warranty since it isn't registered under my name when I checked the status. It has been registered by the previous owner..
 
Ok.. my accelerometer stopped working completely now =/..
Even with rebooting it... it doesn't work :(
 
The best thing is to try taking it into the Apple Store. The worst that can happen is that you'll be out a few bucks for gas and a little bit of time and have the same problem, the best that can happen is they'll hand you a new iPod on the spot.

They should be able to tell from the serial number roughly when it was purchased. Your model came out in Sept 09, as someone else mentioned, so even if it was the first one of that model ever purchased, it's still under warranty. Most likely it was purchased later than that, but it doesn't matter. Take it to an Apple Store.
