I am having smart playlist sync problems with a new iPod Touch 3G with iOS 3.1.3 using iTunes 10.0.0.68. I have read about similar problems here and on other forums with various versions of both iOS and iTunes and different models of iPods as well. The smart playlists I am trying to sync work perfectly in my iPod Classic 160GB and a previous 120GB.

I have tried all the suggestions here: iTunes 9 Issue: Smart Playlists not syncing to iPhone, iPod with no results.

I have two genres of smart playlists, audiobooks and music.

The audiobooks playlists have two rules: Album is name of album and Plays is 0. Match all is checked and I tried it with Live updating both checked and unchecked. The audiobooks are mp3s and are set as Media kind: Audiobook with Remember playback position and Skip when shuffling checked. I use smart playlists for mp3 audiobooks so I don't have the problems associated with concatenating mp3s, which often results in files that skip to the end at the join points. I have no desire to convert them to AAC because of quality loss issues. I have been using this method for a long time on the Classics that I have owned. The problem is that, when the smart playlists sync to the Touch, they are all in random order. Copy to Play Order does not work.

The music playlists have the same rules as the audiobook playlists. Curiously, the music playlists don't even show up on the synced Touch. Again, they work perfectly on the Classics. It is really frustrating that there is any difference in behavior between the two models.

From what I have read, the "shuffling" problem existed in earlier versions of iTunes with iOS 3.x and even 4.x and with iTunes 10 as well. I don't want to update to iOS 4.1 because of reported bugs and the fact that it may render it impossible to, now legally apparently, jailbreak my Touch. I don't think it will solve the problem any way so why risk it?

What I would like to know is if anybody has found a workaround for this problem. I would really like to get this working for the reasons given.
