^^^ I got the same problem as above and mine is also a week 38 one.

So i plan on taking it back to apple. I bought it on the Apple UK store with a discount code, and also my ipod is jailbroken. Will apple replace my 16gb ipod no questions asked?

Nevermind, i pressed home and power button together for a restore and its back to normal now yay
