Can someone tell me in which confitions an ipod needs to be in order for the apple one year warranty replace it free of charge??
And also will they replsce my 2g with a 3g?

Cosmetic conditions shouldn't effect the warranty, so long as it isn't smashed.

The 2g will be swapped for a 2g. There's probably plenty of parts still available.

Condition? Without signs of obvious abuse they will still take care of it - and if the water sensors haven't been triggered.
