is anybody elses mute/ringer button messed up?

I am wondering if anybody has fixed theirs themselves, mainly talking about the iPhone 5. It wont stay silent goes back and forth but if I keep it on it's okay for the most part...which is why I jailbroke for easier control of it. My phone is one of the models they recalled for the power button. I called them to see if I can get it replaced but that it is the ringer button screwed up and I was shot down. It is $269 I believe to fix it out of warranty to hell with that.
